National Poker League brand owner, EventsHQ, has accepted to meet requirements of the Spam Act following an investigation by the Australian Communications and Media Authority (ACMA) into SMS messages sent to consumers which promoted National Poker League events.
According to ACMA, the e-marketing practices of EventsHQ and National Poker League licensees were deficient. For example, consumers who requested to stop receiving messages experienced long delays before messages actually stopped, and some SMS messages failed to identify the authoriser of the message or provide details on how the authoriser could be contacted. These are requirements under the Spam Act which were not met.
The enforceable undertaking means the company must audit its e-marketing and put assurance procedures in place, as well as train employees and licensees to ensure SMS messages comply with the Act. In addition, the company is required to make a payment of $22,000 to ACMA.
On March 1 this year, ACMA registered the Communications Alliance’s Mobile Premium Services (MPS) Code which is intended to eliminate misleading premium rate SMS and MMS service advertisements.
