First Do Not Call investigation launched against telemarketer

More than 250 organizations receive warning letters

Telemarketer Lifestyle Dynamics may be the first head to roll as it faces more than 90 breaches of the Do Not Call Register, enforced by the Australian Communications and Media Authority (ACMA).

The company is facing the first formal investigation under the 2006 Do Not Call Register Act for calling more than 90 numbers formally registered to ensure they are lawfully excluded from receiving telemarketing calls.

The investigation follows repeated written warnings from the ACMA to Lifestyle Dynamics, which continued to contact numbers listed on the registry.

ACMA chairman Chris Chapman said the telmarketer could face "significant penalties" for its breach of the Act.

'Continuing anti-compliance will be acted upon, and the Act carries significant penalties for those offenders," Chapman said.

"ACMA is continuing to monitor telemarketers that are the subject of complaints and will take more formal action where it is warranted."

Around 249 companies have had 250 complaints, relating to breaches of the Act, filed against them since the Do Not Call Register went live on May 31 this year.

Of these, 106 failed to comply within two weeks of written warnings and a further 69 continued to receive complaints four weeks after being notified of breaches.

The Do Not Call Registry has attracted more than 1.6 million registrations since its implementation.

The ACMA declined to comment further until the investigation is completed.
