Oz court to hear Samsung vs Apple iPhone 4S case in March

Samsung will have to wait until March next year to see if its attempt to get sales of the iPhone 4S banned in Australia is successful.

The case will be held in the Australian Federal Court in Sydney and centres on Samsung's claims that the iPhone 4S infringes three of its patents. Samsung is also taking similar actions in France, Japan and Italy, reports Reuters.

"The case will be fixed for a hearing for three weeks, commencing in March, 2012, with the date to be fixed on Friday," justice Annabelle Bennett said today.

Apple's legal team had initially wanted the case to be heard in August but Justice Bennet said this was too far away. As it is, the trial date gives Apple four more months to sell the handset in Australia before a potential ban could come into place.

Meanwhile, Apple and Samsung are due in an Australian courtroom on 25 November to dispute Apple's injunction blocking the sale of Samsung's Galaxy Tab 10.1 tablet in the country.

Similar injunctions are in place in Germany and the Netherlands, while Apple is also trying to block sales of the device in the US.

The iPhone 4S was launched in Australia on 14 October, the same day as the UK, the US, Canada, France, Germany and Japan.
